Terms and conditions
The agreement between you and HomeSomm: what the service is, what you may do with it, who owns the bottles and notes you add, what AI suggestions are worth, and how we settle a disagreement.

Agreement to these terms
These terms are an agreement between you and HomeSomm, which operates HomeSomm. By creating an account, requesting early access or using the app or website, you accept them. If you do not accept them, do not use HomeSomm.
You must be at least 18 years old to use HomeSomm.
The service
HomeSomm is a household wine cellar app: you record the bottles you own and it helps you decide what to open. It is not a wine shop, a valuation service or a marketplace, and it does not appraise your collection or verify authenticity.
HomeSomm is in early access. Features described on this website are the planned launch scope and may change, be delayed or be removed before launch.
Your account and your household
- You are responsible for keeping your sign-in details secure and for everything done through your account.
- A household is a shared cellar. Anyone you invite can see and change every bottle in it, including prices, scores and notes. Invite only people you intend to share that with.
- The account holder who created the household is responsible for the household's use of HomeSomm, including the conduct of the members they invite.
- You can close your account at any time. See the privacy policy for what happens to your data afterwards.
Your content
Everything you put into HomeSomm is yours: your bottle records, tasting notes, scores, label photos, imported spreadsheets and anything else you upload. We call this your content, and we claim no ownership of it.
To run the service we need a limited licence from you. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit and display your content, and to process it through the AI providers described in the privacy policy, solely to operate and improve HomeSomm for you and your household. This licence exists only for as long as we hold your content and ends when you delete it or close your account.
You confirm that you have the right to upload what you upload, and that your content does not infringe anyone else's rights.
We do not use your content to train AI models.
Acceptable use
You agree not to:
- Upload content that is unlawful, defamatory, hateful, or infringes someone else's intellectual property or privacy.
- Use HomeSomm to resell alcohol, to run a commercial cellar operation on a household plan, or to circumvent plan limits.
- Scrape, reverse engineer, or attempt to gain unauthorised access to the service, other households' data, or our infrastructure.
- Automate access in a way that degrades the service for others, other than through the MCP server we provide for that purpose.
- Share your account with people outside your household in place of inviting them.
We may suspend or close an account that breaches these rules. Where the breach is minor and fixable we will tell you first.
AI features and their limits
Label scanning, field completion and the AI sommelier are generated by artificial intelligence. Their output can be inaccurate, incomplete or simply wrong, including drinking windows, serving temperatures, decant times, grape varieties and pairings. Treat them as suggestions and check anything that matters to you.
We are not liable for a bottle opened too early or too late, or for any other decision you make on the basis of an AI suggestion.
Free plan AI actions are capped per month. Premium removes those caps but remains subject to fair use: we may apply reasonable limits to prevent automated abuse.
Plans, payment and cancellation
- The free plan is one user with unlimited bottles and monthly caps on AI actions.
- Premium is one subscription covering the whole household, billed monthly or annually through our payment provider, and renews automatically until you cancel.
- You can cancel at any time. Cancellation takes effect at the end of the paid period and we do not refund the remainder of that period, except where the law requires it.
- Prices shown during early access are introductory and may change at launch. We will tell you before a price change affects an existing subscription.
- If Premium ends, your bottles stay in your cellar. Household sharing, unlimited AI actions and the MCP server stop being available.
Privacy
How we handle your personal data, including cellar content, label photos and AI processing, is set out in our privacy policy, which forms part of this agreement. It explains what we collect, who processes it, how long we keep it and how to get a copy or have it erased.
Our intellectual property
The HomeSomm name, logo, software, design and written content are ours. These terms give you a personal, non-transferable right to use the service, and nothing more. You may not copy, resell or create a competing service from our software or content.
Availability and changes
We aim to keep HomeSomm running but we do not guarantee uninterrupted availability. We may change, suspend or discontinue parts of the service. If we discontinue the service altogether, we will give you reasonable notice and a way to export your cellar first.
We may update these terms. For material changes we will notify you in advance, and continuing to use HomeSomm after the change takes effect means you accept the new terms.
Disclaimers and liability
We provide HomeSomm with reasonable care and skill. Beyond that, we make no promises about the service to the extent the law allows us to make none. If you are a consumer, your mandatory statutory rights are unaffected by anything in this section.
We are liable for damage caused by our intent or gross negligence without limit. For other breaches we are liable only for foreseeable damage that is a direct result of the breach, and our total liability to you in any 12 month period is limited to the amount you paid us in that period, or 50 euro if you are on the free plan, to the extent the law allows such a limit.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Dutch law, including for death, personal injury or fraud, and nothing here affects the statutory rights you have as a consumer.
Governing law and disputes
Talk to us first. Most problems are resolved quickly by writing to support@homesomm.app. We ask that you give us 30 days to resolve a dispute informally before starting a formal proceeding.
These terms are governed by Dutch law. The competent court in the Netherlands has jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, and you may also bring proceedings in your own courts.
Consumers in the European Union can also use the European Commission's online dispute resolution platform.
General
If any part of these terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms without our consent; we may transfer ours if the business is sold, in which case your rights are unaffected.
